BERTSCH Holding GmbH is committed to comprehensive data protection on the Internet. We would therefore like to inform you how we use personal data that we obtain when you visit our website (hereinafter “Data”).

1. DATA CONTROLLER

Controller (GDPR) in respect of the processing of Data is BERTSCH Holding GmbH, of Herrengasse 23, 6700 Bludenz, Austria, registered with the Regional Court of Feldkirch under FN 065689 b, T 0043 5552 6135-0, E privacy@bertsch.at.

2. PROCESSING OF INFORMATION

When you visit our website, our provider, Infound, of A-1050 Vienna (web hoster), will create a log entry on its server containing exclusively the following Data:

- your IP address
- your web browser
- date and time of your visit and the content you viewed or searched on the website 

Infound, our processor, will keep that Data. These Data will not be transferred to any other recipients.

Infound will keep Data for one month and will erase such Data after one month, unless a specific user behaviour justifies an investigation.

2.1 PURPOSE AND LEGAL BASIS

The Data referred to above are collected in order to understand unexpected user behaviour and to be able to detect, prevent and investigate attacks on our website.

We process such information in accordance with our overriding legitimate interests to achieve said purpose. 

2.2 COOKIES

So-called cookies are used on this website. A cookie is a small file that can be stored on your computer when you visit a website. Basically, cookies are used to provide users with additional functions on a website. Through these cookies, we analyse which search terms you enter on our website, which functions you use, how often and for how long, and which sub-pages of our website you visit, how often and for how long. The data collected in this way is pseudonymised by technical precautions. The data can therefore no longer be assigned to you. The data is also not stored together with your other data. The data collected enables us to continuously optimise our website and its functions and to adapt them to your needs. 2.3 Cookies for advertising purposes

Our website uses Google Adwords for advertising purposes and conversion measurement. You can find out more about this under point 5 of this privacy policy.

3. YOUR RIGHTS IN CONNECTION WITH THE PROCESSING OF PERSONAL DATA

In accordance with the applicable data protection law, you have the right to information, correction, deletion, restriction of processing, objection and transferability of the data. You can exercise these rights by contacting the data controller using the contact details above.

You have the right to complain to a supervisory authority in the EU or to the Austrian data protection authority in Vienna if you believe that there has been a breach of European or Austrian data protection law.

4. GOOGLE ANALYTICS 4

This website uses Google Analytics 4, a web analytics service provided by Google Inc, 1600 Amphitheatre Parkway Mountain View, CA 94043, USA ("Google"). Google Analytics 4 uses cookies, scripts and pixels that enable an analysis of your use of the website. For example, the time spent on the website, language and location, the browser used to call up the website, the operating system and the screen size, but also events such as clicks, scrolls, downloads and page views are recorded. 

Using identifiers (user ID, Google ID, device ID), which Google stores in your end device by means of cookies, Google Analytics 4 is able, based on algorithms and machine learning, to recognise usage behaviour across devices from the collected data and events, and in this way automatically combine the sessions into a uniform user experience across devices.

According to Google, the information generated by the cookie about your use of this website will be transmitted to and stored by Google on servers in Ireland. We do not store any of your data collected by Google Analytics 4.

The IP anonymisation is preset for Google Analytics 4. 

On our behalf, Google will use the information collected for the purpose of evaluating your use of the website, compiling reports on website activity and providing other services relating to website activity and internet usage to us.

The tracking technologies described above are used on the basis of your consent given in the cookie banner, which you can revoke there by deactivating the tracking at any time with effect for the future.

5. GOOGLE ADWORDS AND GOOGLE CONVERSION-TRACKING

This website uses Google AdWords. AdWords is an online advertising programme of Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States ("Google").

As a Google AdWords customer, we use so-called conversion tracking within the framework of Google AdWords. When you click on an ad placed by Google, a cookie is set for conversion tracking. If you visit this website while the cookie has not yet expired, Google and we can recognise that you have clicked on the ad and have been redirected to this page.

Each Google AdWords customer receives a different cookie. The cookies cannot be tracked across AdWords customers' websites. The information obtained using the conversion cookie is used to create conversion statistics for AdWords customers who have opted in to conversion tracking. The customers learn the total number of users who clicked on their ad and were redirected to a page tagged with a conversion tracking tag. However, they do not receive any information that personally identifies users.

You only take part in this tracking if you activate it in our cookie consent. Alternatively, you can generally prevent tracking by deactivating the Google conversion tracking cookie via your internet browser under user settings. You will then not be included in the conversion tracking statistics.

6. LEADINFO-TECHNOLOGY

We use the lead generation service of Leadinfo B.V., Rotterdam, Netherlands. This recognises visits by companies to our website by means of IP addresses and shows us publicly available information for this purpose, such as company names or addresses. In addition, Leadinfo sets two first-party cookies to evaluate user behaviour on our website and processes domains from form entries (e.g. "leadinfo.com") in order to correlate IP addresses with companies and improve the services. 

The legal basis for this data processing is your consent, which you can give by activating it in the cookie banner and revoke at any time with future effect by deactivating it .

You can find more information at www.leadinfo.com. On this page: www.leadinfo.com/en/opt-out you also have an opt-out option. In the event of an opt-out, your data will not be collected by Leadinfo.

7. YOUTUBE

We have integrated YouTube components on this website. YouTube is an online video portal which allows you to upload, watch, like and comment video clips free of charge.

YouTube is operated by YouTube, LLC, of 901 Cherry Ave., San Bruno, CA 94066, USA. YouTube, LLC is a subsidiary of Google Inc., of 1600 Amphitheatre Pkwy, Mountain View, CA 94043-1351, USA.

We use the “extended data protection mode” option provided by YouTube. According to YouTube, although YouTube still contacts the Double Klick service of Google in “extended data protection mode”, Google’s privacy policy states that no personally data are analysed.

If you visit the subpages of our website on which a YouTube component (YouTube video) is integrated, a connection is created to the YouTube servers and YouTube receives your IP address in order to send the embedded video to your browser and to play it. YouTube is thereby informed which subpages of our website you visit and which videos you play. If you are logged into YouTube at the same time, that information is allocated to your YouTube account. You can prevent this by logging out of your YouTube account before you visit our website. We are not aware how YouTube uses your data after allocation to your YouTube account and cannot influence any such use.

8 FACEBOOK FANPAGE

Our company operates a fan page on Facebook, the social media platform of Facebook Inc, 1601 S. California Ave, Palo Alto, CA 94304, USA. When you visit this fan page, Facebook sets cookies on your end device, regardless of whether you are a Facebook user yourself. You can find out what cookies are above in point 2 of this data protection declaration. 

Facebook uses these cookies to evaluate your behaviour on our fan page according to certain criteria and to make this evaluation available to us in anonymised form. Facebook calls this service "Facebook Insights". Further information on the processing of Insights data can be found at https://www.facebook.com/legal/terms/information_about_page_insights_data

The Insights data is anonymous for us, but not for Facebook if you are a Facebook user. In this case, Facebook can assign this data to your user account. You can find out more about this in Facebook's privacy policy.

Facebook Ireland and we are jointly responsible for the processing of data for Facebook Insights in accordance with Art 26 of the GDPR. The primary responsibility for the processing of the Insights data lies with Facebook Ireland. We do not make any decisions regarding the processing of the Insights data, in particular not regarding the further recipients of this data or the storage period of the cookies used for this purpose on the end devices.

9 INSTAGRAM

Our website uses so-called social plugins ("plugins") from Instagram, which is operated by Instagram LLC., 1601 Willow Road, Menlo Park, CA 94025, USA ("Instagram"). 

The plugins are marked with an Instagram logo, for example in the form of an "Instagram camera". When you click on the logo, your browser establishes a direct connection to the Instagram servers. The content of the plugin is transmitted by Instagram directly to your browser and integrated into the page. Through this integration, Instagram receives the information that your browser has called up the corresponding page of our website, even if you do not have an Instagram profile or are not currently logged in to Instagram. This information (including your IP address) is transmitted by your browser directly to an Instagram server in the USA and stored there. 

If you are logged in to Instagram, Instagram can directly assign your visit to our website to your Instagram account. The information is also published on your Instagram account and displayed there to your contacts.

10 LINKEDIN

Our website uses so-called social plugins ("plugins") from LinkedIn, which is operated by LinkedIn Ireland Unlimited Company (Wilton Plaza, Wilton Place, Dublin 2 Ireland). 

The plugins are marked with a LinkedIn logo. When you click on the logo, your browser establishes a direct connection to LinkedIn's servers. The content of the plugin is transmitted by LinkedIn directly to your browser and integrated into the page. Through this integration, LinkedIn receives the information that your browser has accessed the corresponding page of our website, even if you do not have a LinkedIn profile or are not currently logged in to LinkedIn. This information (including your IP address) is transmitted by your browser directly to a LinkedIn server and stored there.

12 RECEIVERS OF PERSONAL DATA IN THE USA ("US Providers").

Google LLC, YouTube LLC, Facebook Inc. and Instagram LLC (hereinafter "US Providers") were certified under the US-EU Privacy Shield Agreement and therefore obliged to comply with the requirements of European data protection law. However, we would like to point out that the European Court of Justice annulled the decision by which the EU Commission declared the level of data protection granted by this agreement to be adequate as invalid. 

The transfer of data to the US providers in the USA takes place without appropriate safeguards in accordance with the GDPR. There is a risk for you that these recipients may not be able to comply with European data protection requirements. US data protection law does not grant your data the same protection as the GDPR; in particular, you have only very limited data subject rights. There is also a risk that US authorities may access your data for control and monitoring purposes.

If you either click on "Yes, accept all cookies including US providers" in the cookie consent or specifically agree to the tracking and the associated data transfer to these US providers in the cookie consent, you thereby consent to the use of cookies and the associated transfer of data to the US providers listed above in the USA in accordance with this data protection declaration.
